Terms of Service

These terms govern your use of hypedar ("the Service"), operated by An Nguyen Xuan ("we", "us"). By using hypedar, you agree to these terms. If you don't agree, please don't use the Service.

What hypedar is

hypedar is an AI-powered trend monitoring platform for developers. It monitors sources like arXiv, Hacker News, GitHub Trending, AI blogs, and Reddit — analyzes them with AI — and surfaces opportunities for developers to build open-source implementations.

We offer a hosted version at hypedar.dev (free and paid tiers) and an open-source self-hosted version under the AGPL-3.0 license.

Your account

• You must be at least 16 years old to create an account.
• Accounts are created via third-party OAuth (GitHub or Google). We don't store passwords.
• You are responsible for all activity under your account.
• One account per person. Don't share accounts.
• We may suspend or terminate accounts that violate these terms, after notice where practical.

Acceptable use

You agree not to:

• Spam showcases, comments, or upvotes
• Scrape hypedar content for competing services
• Circumvent rate limits or access controls
• Submit malicious content (XSS, phishing links, malware)
• Impersonate other users
• Use automated access except through our official API (when available)

Community content — showcases, comments, upvotes — must be genuine. Astroturfing and vote manipulation will result in account suspension.

Content and intellectual property

• Your content is yours. You retain ownership of your showcases, comments, and submissions.
• By submitting content, you grant hypedar a non-exclusive, royalty-free license to display it on the platform.
• We do not claim ownership of user-generated content.
• The open-source codebase is licensed under AGPL-3.0.
• Trend data, analyses, and opportunity scores are generated by AI and provided as-is. They are not financial, legal, or professional advice.
• AI-generated opportunity briefs are suggestions to help you find interesting projects — not guarantees of success or accuracy.

Paid subscriptions

The Pro plan is billed monthly ($15/mo) or annually ($144/yr) via LemonSqueezy, our payment processor and Merchant of Record.

• Prices are in USD. Applicable taxes are handled by LemonSqueezy.
• Cancel anytime — your access continues until the end of the current billing period.
• No refunds for partial months, except as required by applicable law.
• We may change pricing with 30 days notice to existing subscribers.
• Showcase boosts are non-refundable one-time purchases.

Data and privacy

We collect minimal data. See our Privacy Policy for specifics on what we collect, why, and how long we keep it.

You can delete your account at any time. All personal data is removed within 30 days of deletion.

Disclaimers

• The Service is provided "as is" and "as available" without warranty of any kind, express or implied.
• AI analyses and scores may contain errors. They are not a substitute for your own judgment.
• We strive for high availability but do not guarantee uninterrupted service.
• We are not responsible for third-party content linked from trends (arXiv papers, HN posts, GitHub repos, etc.).
• Trend scores reflect algorithmic analysis, not editorial endorsement.

Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service is limited to the fees you paid us in the 12 months prior to the claim.

We are not liable for indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunities.

Changes to these terms

We may update these terms. Material changes get 30 days notice via email or a site banner. Continued use after changes take effect constitutes acceptance.

Governing law

These terms are governed by the laws of Vietnam. Disputes will be resolved through good faith negotiation first. If negotiation fails, disputes will be submitted to the competent courts in Ho Chi Minh City, Vietnam.
